Wills

A will drafted properly, witnessed properly, and kept somewhere it will actually be found. Most of the problems we see in estates begin with a will that was written cheaply or not at all.

Lasting Powers of Attorney

An LPA lets you appoint someone you trust to make decisions for you if you later lose mental capacity. It must be made while you still have capacity, which is precisely why so many people leave it too late.

Deputyship applications

Where a person has already lost capacity and no LPA was made, an application to the court is required. It is slower and more expensive than an LPA, and it is avoidable.

Probate

Where there is a valid will, we obtain the grant of probate so that the executor can deal with the estate.

Letters of administration

Where there is no will, we apply for letters of administration and guide the family through the process.

Estate administration and distribution

Collecting in the assets, settling the liabilities and distributing the estate correctly, which is where an executor's personal exposure usually lies.

What happens if I die without a will?
Your estate is distributed under the Intestate Succession Act, which sets a fixed order of beneficiaries. It may bear no relation to what you would have chosen. Different rules apply to Muslims in Singapore under the Administration of Muslim Law Act, and we will tell you at the outset which framework applies to you.
Does my CPF pass under my will?
No, and this surprises almost everyone. CPF monies do not form part of your estate and are distributed according to your CPF nomination, not your will. It is one of the first things we check, because a will and an out-of-date nomination can point in completely different directions.
How long does probate take?
A straightforward estate often takes several months. It takes longer where the assets are complex, where beneficiaries cannot be located, or where somebody disputes the will.
Do I need to update my will after a divorce?
Yes, and you should treat it as urgent. Major life events, including marriage, divorce and children, are exactly the moments when an old will becomes a problem.
